TERMS OF SERVICE

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms of Service (“Terms”). These Terms apply to all visitors, users and others who access or use the Service. PLEASE READ THESE TERMS FULLY BEFORE CONTINUING.

BY ACCESSING OR USING THE SERVICE YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DISAGREE WITH ANY PART OF THE TERMS THEN YOU MAY NOT ACCESS THE SERVICE. EACH PARTICIPANT MUSE REVIEW AND AGREE TO THESE TERMS BEFORE TAKING PART IN ANY EXPERIENCES AT ESCAPE ROOM. FOR ANY PARTICIPANTS UNDER THE AGE OF 18, A PARENT/LEGAL GUARDIAN MUST REVIEW AND AGREE TO THESE TERMS ON THEIR BEHALF. ANYONE UNDER THE AGE OF 16 MUST BE ACCOMPANIED BY AN ADULT.

NO LIABILITY FOR THIRD-PARTY INFORMATION

Escape Room Holdings, LLC (“ERH”) has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. ERH is not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed and construed in accordance with the laws of Nebraska, United States, without regard to its conflict of law provisions. Any disputes related to these Terms or the services provided by ERH must be brought in Nebraska State Court.

TIME FOR COMPLETION

You will be given one hour to complete the game from the time your game master concludes his or her introduction. There are no restrooms or water fountains in the rooms. Customers are responsible for taking care of any personal needs prior to the game. An exit button is provided in each room as a safety measure and can be pressed in case of an emergency.

CANCELLATION POLICY

ERH does not issue cash refunds, but a store credit, or gift card may be given at the management’s discretion. No refunds for cancellations will be given within the last 24 hours before the scheduled booking. A reschedule may also be provided upon request, at the manager’s discretion.

ERH reserves the right to withhold refunds for late cancellations. Large groups (reserving more than one room) must cancel at least 72 hours before their booking to receive a full refund. ERH is not responsible for any booking mistakes made by the customer.

NOTICE TO PERSONS WITH DISABILITIES

Some of our rooms include uneven surfaces and may not be wheelchair accessible. Some require crouching or crawling and may have low lighting. Elements of some rooms may not be appropriate for young children. You are responsible for reading all warnings and requirements for each room prior to booking. GUEST BEHAVIOR POLICY

All Guests are expected to treat ERH staff and property with respect. ERH reserves the right to terminate a game or refuse service to those who intentionally cheat, break equipment, threaten, or disrespect staff or other guests.

ASSUMPTION OF RISK

The escape room events provided by ERH involve known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, blindness, bruises or other injuries; injuries caused by collisions with objects, other participants, or uneven surfaces; medical conditions resulting from physical or mental activity; and damaged clothing or other property. However, such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

By agreeing to these Terms and participating in the escape room event, you are representing:

• That you do not have any known physical or medical condition that would interfere with your safety or the safety of any other guests participating in the escape room activity;
• That you fully understand the inherent risks involved in participating in the escape room activity; and
• That you are voluntarily assuming those risks and want to participate in the activity despite the risks.

If you feel, at any time, that event conditions are unsafe or that you are unable to participate due to physical or medical conditions, you must immediately notify an ERH employee, press the EXIT button in the activity room, and discontinue participating in the activity.

RELEASE OF LIABILITY

By agreeing to these Terms and participating in the escape room event, you are expressly releasing, discharging, and indemnifying ERH from liability for any claims brought by you, your children, parents, heirs, assigns, personal representative and estate arising from any loss or injury suffered while participating in the escape room even provided by ERH. This release includes any claims of negligence against ERH or its representatives, but it does not include any claims arising from intentional misconduct.

DAMAGE TO FACILITIES

By agreeing to these Terms and participating in the escape room event, you hereby agree to reimburse and indemnify ERH for any damage caused to ERH’s facilities or employees by you or anyone in your party while participating in the escape room event.
